Did a little more digging and found the info needed. On the XBLA site for Sonic & Knuckles it says it does. Additionally found on GoNintendo.com, it says the Wii VC version keeps the lock on tech as well.

Delisted Xbox Live Arcade games can only be accessed if they've already been purchased under your account. In that case, they can be re-downloaded by going back through your Purchase History. Outside of that, if you haven't purchased a game yet and it's been delisted, there's no way to get it.

There can be 'achievements' inside Indie games, however they do not increment / tie to your Xbox Live account, it'd be strictly tied to that Indie game. I would assume this is because there would be users with 500k+ achievement scores if the developers were allowed to put in achievements (Ex beating level 1 would give you 1000 points or something).
